Murder is the most serious crime a person in Martin County can be accused of.

It can also be one of the most difficult types of cases to try.

Importantly, the penalties are extraordinarily harsh and can, in some situations, result in the death penalty.

There are three degrees of murder you can be charged with in the State of Florida.

First degree murder results from one of two situations: The killing was premeditated; or it occurred while you were committing another serious crime such as burglary, sexual battery or kidnapping. Punishment ranges from the death penalty to life in prison without parole.
Second degree murder results when there was no premeditation but the crime was carried out with a “malicious mind”, or indifference to the fact that your act had a high risk of causing death or serious bodily harm.

If you were an accomplice in a murder, you may be charged with second degree murder as well, even if you weren’t the one who killed the victim. Punishment ranges from 30 years to life in prison.

Third degree murder applies to an un-premeditated act that was carried out while committing a non-violent felony. Punishment can be up to 10½ years in prison.

Motive does not need to be proven in order to get a conviction in a felony murder case. All that must be proven is that the accused committed the murder.
